On 14 December 2023, Parliament and Council informally agreed on easier access to compensation for individuals suffering damage because of a defective product. IMCO and JURI Members voted on the agreement on 22 February 2024. The text was formally endorsed by Parliament at the plenary of March 2024.
In a nutshell, the new directive provides for:
Easier access to compensation for damage caused by defective productsDamage includes loss of data and impact on psychological healthA requirement to name businesses based in EU that can be held liable for damage
IMCO co-rapporteur Vlad-Marius Botoş (Renew) stated: «The revision of the product liability directive was long awaited. We needed this revision to adapt the liability regime to the new legislation, and to new and innovative products. We must be clear and decide how to cover these new products so that all European citizens have the same rights to be compensated when damage occurs, but it has to be done carefully, to ensure a balance and encourage innovation and the development of new products.»
The new rules will enter into force on the twentieth day following its publication in the EU Official Journal. The new rules will apply to products placed on the market 24 months after entry into force of this directive.
