Vietnam – Draft Decree Amending and Supplementing the Government’s Decree No. 24/2026/ND-CP Dated January 17, 2026, Prescribing Lists of Chemicals Subject to the Scope of Regulation of the Law on Chemicals

The Draft Decree consists of 3 Articles amending and supplementing the Government’s Decree No. 24/2026/ND-CP dated January 17, 2026, prescribing lists of chemicals subject to the scope of regulation of the Law on Chemicals. The main amendments and supplements include: – Amend Appendix I (List of basic chemicals in the key chemical industry sector) to strictly adhere to the criteria stipulated in Clause 2, Article 6 of the Law on Chemicals, avoid indiscriminate incentives, and ensure alignment with the economy’s general development orientation and resource availability at any given time. – Amend Appendix II (List of chemicals subject to conditional production and trading) and Appendix III (List of chemicals subject to special control) by reviewing and reclassifying certain chemicals within these lists to reduce administrative procedures; remove chemicals posing lower risks regarding toxicity to human health and the environment from the management lists; and distinguish between goods containing hazardous chemicals and chemical mixtures regulated by Decree No. 24/2026/NĐ-CP; Simultaneously, consider transferring certain chemicals from the List of chemicals subject to special control to the List of chemicals subject to conditional production and trading to simplify administrative procedures; and reclassify chemicals from «Group 1 chemicals subject to special control» to «Group 2 chemicals subject to special control» in furtherance of the policy on decentralization and the simplification of administrative procedures. Add chemicals to the Lists as proposed by the Ministry of Public Security and the Ministry of Agriculture and Environment, in accordance with Clause 2, Article 5 of Decree No. 24/2026/NĐ-CP. – Amend the information in Appendix IV (List of chemicals requiring the development of a chemical incident prevention and response plan) to align with risk management and the entities at risk requiring management. The Draft Decree also provides transitional arrangements, including: continued validity of licenses and certificates already issued under Decree No. 26/2026/ND-CP prior to the effective date; exemption from compliance requirements for chemicals removed from the conditional production and trading list; a specific transitional rule allowing organizations already certified for all three xylene isomers (o-, m- and p-xylene) to continue trading in xylene (CAS 1330-20-7) until their existing certificates expire; and a compliance deadline of December 31, 2027 for chemicals newly added to the list of chemicals subject to special control​.
