The hearing aims at clarifying the state of play of the enforcement of sanctions adopted by the EU against Russia and Belarus,
at assessing the extent to which they have been successful and at identifying the main constraints stemming from international law. International relations experts, EU officials in charge of sanctions and possibly an Ukrainian representative will participate to provide answers to the following questions:
Does international law both allow for and constrain the imposition and enforcement of sanctions, and if yes, in which ways?Which jurisdictions could hear cases of potential breaches of international law like the violation of State assets immunity? What are the legal and factual obstacles to the imposition and enforcement of sanctions?Is the enforcement of sanctions effective and consistent across EU?What is your assessment of the Canadian and US approaches to forfeiture, i.e. confiscation, under international law? Moreover, could the Canadian approach inspire the one of EU?
